TRANSACTIONAL
Flat Rates apply for most transactional (non-litigation) matters. Estate planning, Trust and Will drafting, real estate closings, business formations, deeds, advice and consultation are flat rate.
LITIGATION:
Litigation, when the matter is in front of a Judge, will only be handled on an hourly billing rate. Litigation is uncertain – the other side may file many motions, pursue depositions or discovery – means that assessing costs at a flat rate are impossible.
Limited Scope Litigation:
Limited scope services (also known as unbundled or discrete services) are an option when the client needs limited representation. Examples include assistance in drafting documents, writing briefs, consultation on contract terms or managing pre-litigation discovery or a court hearing appearance. The attorney only handles the limited services.
